Brian M. Wcislo
About
Regarded by some as the Doogie Houser of the legal profession, Brian achieved fame at one of his Australian client's headquarters by wearing flip flops to work daily. Having eventually come to the conclusion that working in a law firm is no fun, he started Wcislo Law Group in 2016 with the modesty stated ambition of completely changing the way law is practiced.
Apart from his well-deserved reputation as a shameless self-promoter, Brian is actually a lawyer too. His expertise is in commercial litigation and product liability defense, and he does stuff like fending off hostile company takeovers, dropping buses off overpasses to test their crashworthiness, mergers and acquisitions, and shareholder derivative suits. Big workplace discrimination cases and some celebrity litigation too, but he doesn't like to mention it much. Brian is pragmatic, direct and confident, navigating our clients through the strange maze of complex company operating agreements to straightforward commercial results and no lawyerish crap along the way. He's versatile, endlessly accommodating and is accessible to his clients 24/7.

- Obtained a preliminary injunction from a franchisee to comply with Franchise Agreement while litigation is pending for breach of contract and trademark infringement.
- Cause No. 21-4098, United States Court of Appeals for the Sixth Circuit, Blue Fire Capital, LLC v. Pies & Pints Development Partners, LLC
- Successfully defended against an appeal of the trial court order below.
- Cause No. 2:20-cv-2982, United States District Court for the Southern District of Ohio, Blue Fire Capital, LLC v. Pies & Pints Development Partners, LLC
- Successfully represented a shareholder and CEO against an attempted coup by partners and existing shareholders. Brian's client came to him after getting fired as CEO and kicked off the board. In a matter of thirty days, Brian successfully took the company back over, on behalf of his client, by navigating multiple complex operating agreements, which precipitated the subject litigation. Brian and local counsel successfully obtained a Rule 12(b) motion ruling in his client's favor, dismissing the case, along with prevailing in the defense of two motions for temporary restraining orders.
- Cause No. 19-ST-CV-39917, Superior Court of the State of California in and for the County of Los Angeles, Central District, Jane Doe v. Johnson-Peltier et al.
- Brian was retained after this case was filed. Brian, with the assistance of local counsel in Los Angeles had the case settled within three months of being retained and obtained a mid-seven figure settlement for his client.
- Cause No. DC-22-01740, In the 95th Judicial District Court of Dallas County, Texas, Mauricio Estrada v. Boss Exotics, LLC et al.
- Successfully defended a summary judgment order for $108,743.63 and settled it down to $15,000. Plaintiff breached the settlement agreement and Brian quickly filed suit (Cause No. DC-06469) and obtained a judgment for $95,856.96.
- Cause No. DC-22-03336, In the 160th Judicial District Court of Dallas County, Texas, Boss Exotics, LLC et al. v. Hugo Gonzales
- Successfully litigated a fraudulent exotic car sale up to filing a motion for summary judgment compelling the defendant to file bankruptcy.
- Successfully defended an Australian company headquartered in Dallas, Texas, against claims for unpaid commissions in the past and future (in perpetuity) totaling over seven figures. Brian obtained a favorable settlement for clients that was a fraction of the claim amount.
- Successfully defended a truck dealership in Dallas, Texas, in shareholder dispute regarding alleged breaches of the company's operating agreement, fraud, and civil theft. Obtained favorable settlement for client pre-trial that was far less than the seven figure claim amount.
- Successfully defended a trucking company from a frivolous lawsuit filed by, ironically, an individual being sued for fraud, relating to a consulting agreement and alleged ownership in Defendant’s business. Brian and co-counsel obtained a $15,000 settlement on behalf of his client with the original claim amount totaling seven figures.
- Successfully represented an individual in California claiming multiple EEOC violations and obtained a favorable pre-trial settlement for his client. Settlement terms are confidential.
- Successfully represented an individual in Texas claiming multiple EEOC violations and obtained a favorable pre-trial settlement for his client. Settlement terms are confidential.
- Successfully quarterbacked mergers and acquisitions of businesses on behalf of his clients in CA, OH, and TX.
